2. About Pet Budd and Our Fulfillment Model
Pet Budd operates an online store offering pet-care accessories and
related products.
We use a dropshipping model. Products may be sourced, packed, and
shipped directly to customers by third-party suppliers or fulfillment
providers. We may use AutoDS or another order-management service to
route orders to suppliers.
Unless expressly stated otherwise on a product page, Pet Budd does not
manufacture the products sold through the store.
Your purchase contract is with Veltrix Nova S.L. / Pet Budd, not
with AutoDS or the third-party supplier. Our use of third-party
fulfillment does not remove any responsibility that applicable law
places on us as the seller.
3. Eligibility
You must have legal capacity to enter into a purchase contract under the
law applicable to you. Where required, a minor must have authorization
from a parent or legal guardian.
4. Products, Product Information and Availability
We make reasonable efforts to present product information accurately.
Because products may be supplied by third parties:

packaging, color shades, or minor non-material details may change;

availability may change without notice;

supplier-provided images may be illustrative;

product specifications must be read together with any safety
instructions, warnings, manufacturer information, and
responsible-person information displayed on the relevant product
page or accompanying the product.
We may correct genuine typographical or pricing errors and may cancel an
order if a product is unavailable or cannot lawfully be supplied. If we
cancel an order after payment, amounts paid for the cancelled item will
be refunded.
Nothing in these Terms permits us to substitute a materially different
product without the customer's agreement where such substitution would
violate applicable consumer law.
5. Prices, Taxes and Payment
The total price and any applicable shipping charges, taxes, or other
mandatory charges will be shown as required before you place the order.
Payments are processed by third-party payment providers. We do not
intentionally store complete payment-card details.
By placing an order, you confirm that you are authorized to use the
selected payment method.
6. Order Acceptance
Submitting an order is an offer to purchase the selected products. An
automated order acknowledgement does not necessarily mean that we have
accepted the order.
We may refuse or cancel an order for legitimate reasons, including
suspected fraud, obvious pricing errors, supplier unavailability, legal
restrictions, or inability to deliver to the requested destination. If
payment has already been captured for a cancelled order, the relevant
amount will be refunded.
7. Shipping and Delivery
We currently offer free shipping where stated on the website.
Estimated delivery times are estimates and may vary due to supplier
processing, carriers, customs, destination, stock, or circumstances
outside our reasonable control.
For consumer sales, mandatory statutory rules regarding delivery and
transfer of risk apply. Risk generally does not pass to an EU consumer
merely because the supplier hands the parcel to a carrier selected
within our fulfillment chain.

8. Returns, Withdrawals, Exchanges and Refunds
No Voluntary Returns or Refunds
Except where required by mandatory law, all sales are final. Pet
Budd does not offer a separate commercial or voluntary right to return
or exchange products simply because a customer changes their mind, no
longer wants the product, ordered the wrong item, dislikes a
non-defective product, or for another reason not protected by mandatory
law.
However, this "all sales final" rule does not override rights that
cannot legally be excluded.
EU/EEA Statutory Right of Withdrawal
Where the statutory right of withdrawal applies to a consumer's distance
purchase, the consumer may withdraw within the legally required period,
generally 14 calendar days after receiving the goods, without giving
a reason.
For a change-of-mind statutory withdrawal, the customer must arrange
and pay the direct cost of returning the goods, where permitted by law
and where the customer was properly informed of that obligation before
purchase. Pet Budd does not provide prepaid return labels and does not
reimburse those return-shipping costs, except where mandatory law
requires otherwise.
The statutory right of withdrawal does not apply where a legal exception
applies. This can include, among other cases, sealed goods that are
not suitable for return for health-protection or hygiene reasons once
unsealed after delivery, provided the legal conditions for that
exception are actually satisfied.
We will not describe a product as non-returnable for hygiene reasons
unless the product and the circumstances genuinely fall within the
applicable legal exception.
Defective, Damaged, Incorrect or Non-Conforming Goods
The "all sales final" rule does not limit mandatory legal rights for
goods that are defective, damaged, incorrect, unsafe, or otherwise not
in conformity with the sales contract.
Where Spanish consumer law applies, statutory conformity rights may
apply for three years from delivery. Depending on the circumstances
and applicable law, remedies may include repair or replacement and,
where legally available, a price reduction or termination of the
contract/refund.

9. Intellectual Property
Pet Budd owns or has rights to the Pet Budd name, logo, branding,
website design, and original content created by us. Those materials
are protected by applicable intellectual-property laws.
Certain product photographs, videos, descriptions, specifications,
trademarks, logos, brand names, manuals, and other materials displayed
on the store may be owned by or provided by third-party suppliers,
manufacturers, licensors, or other rights holders. Those materials
remain the property of their respective owners.
The fact that Pet Budd sells a third-party product does not mean that
Pet Budd owns the intellectual-property rights associated with that
product, manufacturer, brand, image, or other third-party material.
Third-party materials are used only where we have permission, a licence,
or another lawful basis to use them. Nothing in these Terms transfers
third-party intellectual-property rights to Pet Budd or to customers.
You may not reproduce or commercially exploit Pet Budd-owned content
without our permission, except where permitted by law.
10. Acceptable Use
You must not:

use the website for unlawful or fraudulent purposes;

attempt unauthorized access to the website, accounts, or systems;

interfere with the security or operation of the website;

submit knowingly false or fraudulent order, payment, withdrawal,
delivery, or product claims; -
use website content in a manner that infringes the rights of Pet
Budd or third parties.
11. Third-Party Services and Links
Our website may rely on or link to third-party services, including
Shopify, payment providers, AutoDS, carriers, and suppliers.
Those third parties may have their own terms and privacy policies.
However, where Pet Budd is the seller to the consumer, our use of a
third-party supplier or fulfillment provider does not by itself transfer
our statutory seller obligations to the customer.
12. Disclaimers
To the fullest extent permitted by law, we do not provide additional
commercial warranties beyond those expressly stated by us.
Nothing in these Terms excludes or restricts mandatory statutory rights,
including rights relating to product conformity, product safety,
withdrawal where applicable, or liability that cannot legally be
excluded.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Pet Budd is not
liable for indirect or consequential loss that was not reasonably
foreseeable or for loss caused by misuse of a product contrary to clear
instructions or warnings.
Nothing in these Terms excludes or limits liability where exclusion or
limitation is prohibited by law, including applicable liability for
death or personal injury caused by negligence, fraud, defective
products, or mandatory consumer-protection obligations.
Any contractual liability cap stated or relied upon by us applies only
to the extent it is legally enforceable and does not restrict mandatory
consumer remedies.
14. Indemnification
To the extent permitted by applicable law, a user may be responsible for
losses reasonably resulting from their unlawful misuse of the Services
or intentional violation of these Terms.
This clause does not require a consumer to indemnify Pet Budd for
matters for which such an obligation would be unfair, unlawful, or
unenforceable.
15. Privacy and Cookies
Use of the website is also governed by our Privacy Policy and Cookie
Policy.
16. Changes to These Terms
We may update these Terms for future use of the Services. Changes do not
retroactively remove rights already acquired under an existing consumer
contract unless applicable law permits it.
17. Governing Law and Consumer Jurisdiction
These Terms are governed by Spanish law.
If you are a consumer habitually resident in another EU/EEA country,
this choice of law does not deprive you of mandatory consumer protection
available under the law that would otherwise apply to you.
Nothing in these Terms deprives a consumer of a court or jurisdiction
right that cannot lawfully be waived.
